This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and describes privacy rights that may be available under applicable United States federal and state laws.

This Policy applies to POSHighway.com and to personal information POS Highway collects through website forms, sales communications, product inquiries, demonstrations, customer relationships, implementation and support services, events, and other business interactions unless a separate privacy notice applies.

We may collect information included in requests for quotations, product demonstrations, sales inquiries, emails, phone calls, support tickets, project communications, training requests, surveys, and other correspondence.

  • Support and Technical Information

When providing implementation or technical support, we may receive information about devices, software versions, system configuration, error messages, logs, screenshots, network conditions, database information, user accounts, or other information reasonably necessary to diagnose or resolve an issue.

Where remote access is used, access will be used for the authorized support or service purpose and subject to applicable agreements and security procedures.

  • Website and Device Information

When you visit our website, certain information may be collected automatically, including IP address, browser type, device information, operating system, referring pages, pages viewed, approximate location derived from IP address, timestamps, and interactions with the website.

  • Cookies and Similar Technologies

We may use cookies, pixels, tags, analytics technologies, local storage, or similar technologies to operate the website, remember preferences, understand website performance, analyze traffic, improve content, maintain security, and, where applicable, measure or personalize marketing.

The technologies actually used on POSHighway.com may change as our website and service providers change.

  1. Sources of Personal Information

We may obtain personal information directly from you, from your employer or organization, through POSHighway.com, through customer-support and sales interactions, through transactions, from software and service providers used to support our business, from referral partners, from publicly available business information, or from other sources permitted by law.

  1. How We Use Personal Information

We may use personal information to operate our website; respond to inquiries; schedule demonstrations; prepare quotations and proposals; process transactions; provide software, hardware, hosting, implementation, training, consulting, and support; administer customer accounts; communicate regarding subscriptions, renewals, invoices, licenses, security, and service matters; troubleshoot technical issues; maintain and improve products and services; prevent fraud and security incidents; analyze website performance; comply with legal obligations; maintain business records; protect our legal rights; and send marketing communications where permitted by law.

We may also use information for other purposes disclosed at the time it is collected or with your authorization.

  1. How We Disclose Personal Information

POS Highway may disclose personal information to service providers that perform functions on our behalf, including cloud-hosting providers, IT providers, payment processors, shipping companies, communications providers, analytics providers, marketing providers, customer-support platforms, and professional advisers.

Information may also be provided to software publishers, manufacturers, integration partners, payment providers, cloud-service providers, or other technology companies when necessary to fulfill an order, activate a license, configure an integration, deliver a service, or provide requested support.

We may disclose information when reasonably necessary to comply with law, legal process, court orders, regulatory requirements, or lawful government requests; investigate fraud or security incidents; enforce agreements; protect legal rights; or protect the safety and security of customers, users, employees, or systems.

If POS Highway is involved in a merger, acquisition, financing, sale of assets, reorganization, or similar transaction, personal information may be disclosed as part of that transaction subject to applicable law.

  1. Sale, Sharing and Targeted Advertising

POS Highway does not sell personal information in exchange for money.

Some website analytics or advertising technologies may involve disclosures that certain U.S. state privacy laws define broadly as a “sale,” “sharing,” or processing for targeted advertising even where no money is exchanged.

Where our activities fall within those definitions and applicable law requires an opt-out, eligible residents may exercise that right through the privacy controls provided on our website or by contacting us as described below.

Where required by applicable law, we will also recognize qualifying browser-based universal opt-out preference signals, such as Global Privacy Control, for the browser or device through which the signal is received.

  1. Cookies and Privacy Preferences

Certain cookies are necessary for website functionality and security.

Other cookies or technologies may support analytics, personalization, performance measurement, or advertising.

Where required by applicable law, POS Highway will provide appropriate choices concerning non-essential cookies or other processing.

Deleting or blocking cookies may affect certain website functions.

Browser-level privacy controls generally apply only to the browser and device on which they are configured.

  1. Email and Marketing Communications

We may send marketing emails concerning POS Highway products, services, educational information, events, promotions, or other business information as permitted by applicable law.

You may unsubscribe from qualifying marketing emails by using the unsubscribe link contained in the message.

We may continue sending transactional or relationship communications necessary to administer an existing business relationship, including invoices, security notices, product notices, subscription information, account messages, support communications, and other non-promotional messages.

  1. Information Security

POS Highway uses reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

Our safeguards are designed to take into account the nature of the information, the systems involved, and the circumstances in which information is processed.

However, no website, network, database, cloud environment, storage system, or electronic transmission method can be guaranteed to be completely secure.

If a security incident involving personal information occurs, POS Highway will investigate the incident and provide notifications or take other actions where required under applicable federal or state law, including applicable Hawaii and New York breach-notification requirements.

  1. Data Retention

We retain personal information for no longer than reasonably necessary for the purposes for which it was collected, including providing products and services, administering customer relationships, maintaining business and financial records, resolving disputes, protecting security, enforcing agreements, meeting contractual obligations, and complying with applicable legal requirements.

Retention periods vary according to the type of information, purpose of processing, contractual obligations, and applicable law.

When personal information is no longer reasonably necessary, we may delete, anonymize, or otherwise dispose of it in accordance with our retention practices and legal obligations.

  1. U.S. State Privacy Rights

Privacy laws in a number of U.S. states provide qualifying residents with rights concerning personal information.

Depending on your state of residence, the applicability of a particular law, and applicable exceptions, you may have the right to confirm whether we process your personal information; access personal information; request correction of inaccurate information; request deletion; obtain a portable copy of certain information; opt out of the sale of personal information; opt out of sharing for cross-context behavioral advertising; opt out of targeted advertising; opt out of certain profiling or automated decision-making activities; limit certain uses or disclosures of sensitive personal information; withdraw consent for certain processing; or appeal a decision concerning a privacy request.

The availability and scope of these rights vary by state.

POS Highway will not discriminate against an individual for exercising a privacy right protected by applicable law.

  1. California Privacy Rights

If POS Highway is subject to the California Consumer Privacy Act (“CCPA”) with respect to your information, California residents may have additional rights.

These may include the right to know the categories and specific pieces of personal information collected; know the categories of sources from which information was collected; know the purposes for which information was collected, sold, or shared; know categories of third parties to whom information was disclosed; request deletion; request correction; opt out of sale or sharing; limit certain uses of sensitive personal information where applicable; and receive equal service and pricing when exercising CCPA rights.

The categories of information POS Highway may collect are described in this Privacy Policy and may include identifiers, commercial information, internet or electronic activity, professional or employment-related information, approximate geolocation information, customer-service information, and other information voluntarily provided to us.

The sources, purposes, and categories of recipients are also described in this Policy.

If POS Highway engages in processing treated as a sale or sharing under California law, California residents may use the designated opt-out mechanism provided on our website.

Where required, qualifying opt-out preference signals will also be processed in accordance with California law.

  1. Sensitive Personal Information

POS Highway generally does not seek sensitive personal information from ordinary visitors to our website unless it is reasonably necessary for a specific transaction, service, security requirement, employment process, or other authorized purpose.

Where applicable state law requires consent or provides a right to limit certain processing of sensitive personal information, POS Highway will provide the required mechanism.

Please do not submit Social Security numbers, government identification numbers, passwords, complete payment-card numbers, medical information, biometric information, or other highly sensitive information through ordinary website contact forms unless specifically requested through an appropriate secure process.

  1. Exercising Your Privacy Rights

To exercise a privacy right, you may submit a request through our designated privacy-request method.

Privacy Request Email: helpdesk@computant.com

You may also send a written request to:

DataNet Systems, Inc. d/b/a POS Highway
Attn: Privacy
600 Kapiolani Blvd, Suite 302
Honolulu, HI 96813

A request should provide enough information for us to reasonably identify the individual and understand the request.

We may need to verify your identity before fulfilling certain requests. Verification methods will depend on the sensitivity of the information and type of request.

If we cannot verify a request or an exception applies, we may deny or limit the request and will provide an explanation where required by law.

  1. Authorized Agents

Where permitted by applicable law, you may authorize another person to submit certain privacy requests on your behalf.

We may request evidence that the agent has authority to act for you and may separately verify your identity where allowed or required.

  1. Appeals

Residents of states that provide a right to appeal a denied privacy request may submit an appeal using the privacy contact method described above.

The appeal should identify the original request and state that you are requesting an appeal.

We will review qualifying appeals and respond within the timeframe required by applicable law.

  1. Children’s Privacy

POSHighway.com and POS Highway’s business technology products and services are not directed to children under 13.

We do not knowingly collect personal information online from children under 13 in circumstances covered by the Children’s Online Privacy Protection Act.

If we learn that personal information was collected from a child in violation of applicable law, we will take appropriate steps to delete or otherwise address that information.

Additional protections for minors will be applied where required by applicable state law.

  1. Third-Party Websites and Integrations

POSHighway.com may contain links to third-party websites, software providers, manufacturers, payment providers, social networks, or other services.

Those third parties operate independently and may maintain their own privacy policies and data practices.

This Privacy Policy does not govern information collected directly by an independent third party.

We encourage users to review the privacy notice of a third-party service before providing personal information to that service.

  1. Customer Data Processed on Behalf of Businesses

In some situations, POS Highway may process personal information on behalf of a business customer while providing hosting, support, integration, implementation, development, or similar services.

In those circumstances, the customer may determine the purposes and means of processing and POS Highway may act as a service provider, contractor, or processor under applicable law.

Individuals seeking to exercise rights relating to data controlled by a POS Highway customer may need to submit the request directly to that customer.

Applicable customer agreements or data-processing agreements may provide additional information about these relationships.

  1. Do Not Track and Universal Opt-Out Signals

Traditional browser “Do Not Track” signals do not have a single uniform legal standard across the United States.

Where applicable state law requires recognition of an approved or qualifying universal opt-out mechanism, POS Highway will process qualifying signals in accordance with applicable requirements.

  1. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our website, products, services, technology, business practices, or applicable legal requirements.

When we make changes, we will update the “Last Updated” date at the top of this Policy.

If required by law, we will provide additional notice or obtain consent before applying material changes to personal information previously collected.
